Dulais ('we', 'us', or 'our') respects the intellectual property rights of artists, developers, authors, and corporate copyright holders, and we expect all users, syndication networks, and game publishers to uphold the same high legal and ethical standards. It is our strict policy to respond expeditiously to legitimate notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (Title 17, United States Code, Section 512, commonly known as the 'DMCA') and international intellectual property treaties.

This comprehensive document outlines our platform's operating procedures, the formal requirements for copyright owners or authorized representatives to submit a Notice of Claimed Infringement, our counter-notification process, and our policy concerning repeat infringers.

1. Nature of Our Gaming Aggregation Service

Dulais operates as an online web directory and aggregation platform that provides players with access to free-to-play HTML5 games hosted and syndicated across legitimate distribution networks, notably GameMonetize and authorized independent developers. The games displayed on our portal are delivered via HTML5 sandboxed iframes pointing to third-party host servers.

We do not intentionally store, reproduce, or distribute pirated software or unauthorized copyrighted files on our origin servers. Because our catalog references third-party syndication feeds, we maintain a robust, transparent, and expedited notice-and-takedown mechanism to ensure that any material identified as infringing can be promptly disabled, unlinked, or removed from public view.

2. Requirements for Filing a Formal DMCA Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright law, please report alleged copyright infringements occurring on or through Dulais by providing our Designated Copyright Agent with a formal Written Notification containing each of the following six statutory elements:

  1. Identification of the Copyrighted Work: A clear and detailed description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you must provide a representative catalog of such works (e.g., the title, registration number, or official URL of your original work).
  2. Identification of the Allegedly Infringing Material: A precise identification of the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled. You must include the exact, full URL(s) on Dulais where the material is accessible, as general website names alone are insufficient for our team to locate specific items.
  3. Contact Information of the Complaining Party: Accurate and comprehensive contact details reasonably sufficient to permit Dulais to communicate with you, including your full legal name, professional title, company name (if applicable), mailing address, telephone number, and a verifiable email address.
  4. Good Faith Belief Statement: A formal statement declaring: 'I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (such as fair use).'
  5. Accuracy & Penalty of Perjury Declaration: A statement declaring: 'I declare, under penalty of perjury, that the information in this notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.'
  6. Physical or Electronic Signature: A physical or valid electronic signature (such as typing your full legal name) of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

3. Where to Submit Your DMCA Takedown Notice

To ensure your notification is processed without delay, please send your completed DMCA Notice via email directly to our Designated Copyright Agent:

4. Takedown & Notification Protocol

Upon receipt of a valid and complete DMCA Notice adhering to the statutory requirements described above, Dulais will initiate the following protocol:

  • Acknowledge receipt of your notification within 24 to 48 business hours;
  • Review the submitted URLs and documentation to verify the location of the disputed material;
  • Expeditiously remove, disable public access to, or unlink the allegedly infringing game embed from Dulais;
  • Provide written notice of the removal to the affected game developer, studio, or syndication network, including a copy of the takedown notice;
  • Maintain a permanent digital log of the takedown for internal compliance and statutory audit purposes.

5. Counter-Notification Procedure for Content Providers

If a game developer, content provider, or syndication partner believes that the material that was removed (or to which access was disabled) is not infringing, or that they possess legitimate authorization from the copyright owner, the copyright owner's agent, or pursuant to statutory law (such as fair use or licensing agreements), they may submit a formal Written Counter-Notification to our Designated Agent containing:

  1. Their physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled, including the specific URL on Dulais where the material appeared before removal;
  3. A statement under penalty of perjury declaring: 'I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.';
  4. Their full legal name, physical mailing address, telephone number, and email address;
  5. A statement that they consent to the jurisdiction of the federal or local court in which their address is located, and that they will accept service of process from the individual who provided the original DMCA notification or an agent of such person.

If a valid Counter-Notification is received by our Designated Agent, Dulais will forward a copy to the original complaining party informing them that we may restore the removed material or cease disabling access to it within 10 to 14 business days, unless the copyright owner files a court action seeking a judicial restraining order against the content provider.

6. Repeat Infringer Policy

In strict adherence to Section 512(i) of the DMCA and international digital standards, Dulais enforces a clear repeat infringer policy. We will terminate, in appropriate circumstances and at our sole discretion, the publishing privileges, syndication agreements, or accounts of any developer, provider, or partner determined to be a repeat infringer. We also reserve the right to ban third-party syndication feeds or external domains that repeatedly distribute unauthorized content.

7. Misrepresentations & Legal Consequences

Please note that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be held liable for statutory civil damages, court costs, and reasonable attorney's fees incurred by the alleged infringer, by the copyright owner, or by Dulais as a service provider.
