4. Acceptable Use Policy & Prohibited Conduct
The foundational spirit of Dulais is rooted in personal growth, introspective honesty, and mindful self-compassion. To protect our technical infrastructure and the sanctity of our community, you strictly agree NOT to engage in any of the following prohibited behaviors:
- Harassment, Stalking & Unsolicited Threats: You may not use our automated delivery service as an instrument of targeted harassment, psychological abuse, non-consensual contact, defamation, or intimidation directed at third parties. The service is fundamentally engineered for letters addressed to yourself or willing, consenting loved ones.
- Unlawful and Harmful Content: Storing, transmitting, or scheduling materials that violate applicable criminal or civil statutes, including materials that promote acts of terrorism, depict child sexual exploitation, facilitate hate speech, or infringe upon third-party trade secrets.
- Malicious Code and Phishing: Embedding malicious hypertext links, malware, spyware, worms, ransomware, Trojan horses, or fraudulent phishing mechanisms intended to deceive recipients upon future opening.
- Automated Flooding and Infrastructure Abuse: Deploying automated headless browsers, web scraping robots, crawlers, or high-volume scripts designed to overload server capacity, exhaust database connection pools, or bypass anti-bot security controls.
- Commercial Spam and Unsolicited Solicitations: Using our letter dispatch engine to transmit mass commercial promotional solicitations, pyramid scheme advertisements, or unsolicited marketing campaigns.
We reserve the absolute, unilateral right to delete letters, suspend or terminate accounts, and cooperate with law enforcement authorities in the event of any detected violation of this Acceptable Use Policy.
5. Intellectual Property Rights and Content Licensing
A. Unquestioned Ownership of Private Manuscripts
You retain 100% full, exclusive, and unencumbered intellectual property ownership and copyright over all text, thoughts, personal histories, and creative prose you write on Dulais. We do not claim, nor will we ever assert, proprietary copyright ownership over your private letters.

If, and only if, you explicitly toggle the audience parameter to "Public, but anonymous," you grant Dulais and its successors a perpetual, worldwide, royalty-free, non-exclusive, sublicensable license to publish, display, format, syndicate, translate, and archive that specific letter on our community wall, reading apps, and promotional editorial showcases. You acknowledge that public letters are presented without author names or identifying email addresses to safeguard author anonymity.
C. Platform Proprietary Rights
All software architectures, database schemas, stylesheets, user interfaces, logos, graphic assets, typography configurations, slogans, and documentation associated with Dulais represent the exclusive intellectual property of the Platform operator and are protected by international copyright, trademark, and unfair competition laws.
6. Realistic Limitations of Temporal Delivery & Technical Disclaimers
Transmitting electronic communications across multi-year temporal intervals (up to 10 years into the future) involves technical realities and external dependencies that cannot be guaranteed with mathematical absolute certainty. You acknowledge, understand, and agree to the following operational parameters:
- Recipient Mailbox Viability: We possess no technical control over whether your chosen recipient email address will remain active, open, monitored, or un-decommissioned by its provider across 1 to 10 years. You are strongly advised to utilize a permanent personal primary email rather than temporary university or corporate inboxes.
- Third-Party Ingress Filtering: Recipient mail servers (e.g., Google Gmail, Microsoft Outlook, Apple iCloud) continually alter anti-spam heuristics, enforce inbox quotas, or reject emails based on evolving authentication policies. While we utilize authenticated SPF, DKIM, and TLS protocols, we cannot guarantee that a recipient's mail provider will not place a delivered capsule into an archival or spam folder.
- Service Evolution and Infrastructure Shifts: While we maintain redundant automated database backups and failover architecture designed to persist across decades, you acknowledge that unforeseen catastrophes, geopolitical sanctions, natural disasters, or total Internet protocol restructuring represent force majeure events outside our reasonable control.
7. Comprehensive Limitation of Liability & Warranty Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES PROVIDED BY Dulais ARE DELIVERED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
UNDER NO CIRCUMSTANCES SHALL Dulais, ITS FOUNDERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR SERVICE PROVIDERS BE HELD LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF MEMORIES, DATA CORRUPTION, EMOTIONAL DISTRESS, LOSS OF ANTICIPATED PROFITS, OR SERVICE INTERRUPTIONS) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ALL EVENTS, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL BE STRICTLY LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO THE PLATFORM DURING THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) TWENTY-FIVE UNITED STATES DOLLARS ($25.00 USD).
8. Indemnification
You agree to defend, indemnify, and hold harmless Dulais, its operators, affiliates, licensors, and employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or reasonable legal fees resulting from your violation of these Terms, your unauthorized use of the Platform, or the content of any letters you author and transmit.
9. Third-Party Advertising & Google AdSense Network
The Platform integrates third-party advertisements delivered by Google AdSense and affiliated networks to fund free storage and operational hosting. Commercial advertisements displayed on our site are provided by third-party advertisers; we neither endorse nor guarantee any product, service, or proposition advertised. Your interactions with advertisers found on our platform are governed exclusively by the terms and policies of those respective third-party entities.
10. Dispute Resolution, Governing Law & Severability
These Terms shall be governed by, construed, and enforced in accordance with international digital commerce principles and the substantive laws of the operating entity's primary corporate domicile, without regard to conflict of law doctrines. In the event that any provision of these Terms is deemed unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, that specific provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
